Pre-Purchase Vehicle Inspection Terms & Conditions
Effective Date: September 4, 2026
These Terms & Conditions apply to mobile pre-purchase vehicle inspection services provided by ClearPath Auto Check LLC (“ClearPath Auto Check,” “we,” “us,” or “our”).
By submitting payment for an inspection, the purchasing client (“client,” “you,” or “your”) acknowledges that they have reviewed, understood, and agreed to these Terms & Conditions.
1. Purpose of the Inspection
ClearPath Auto Check provides pre-purchase vehicle inspections for informational purposes.
The purpose of the inspection is to document the observable condition and basic operation of accessible vehicle systems and components at the time the inspection is performed. Inspection findings are intended to provide the client with additional information regarding the vehicle before a purchase or similar transaction.
An inspection is not a guarantee of vehicle condition, reliability, safety, value, future performance, or freedom from defects.
ClearPath Auto Check does not make purchasing decisions on behalf of the client and does not represent that a vehicle should or should not be purchased.
2. Nature and Scope of the Inspection
Inspections are visual, observational, functional, and non-invasive.
Depending on vehicle configuration, condition, access, equipment compatibility, seller authorization, and surrounding conditions, the inspection may include observation or functional review of accessible areas such as:
Exterior body and visible finish condition
Interior condition and accessible controls
Engine compartment
Accessible fluids and fluid levels
Visible evidence of leaks or residue
Tires and visible tire information
Accessible brake components
Steering and suspension components
Accessible underbody areas
Battery and charging-system information
Exterior and interior lighting
Safety restraints and warning indicators
Instrument cluster operation
Accessible electronic features
Diagnostic scan information where available
Visible evidence of prior repair, damage, modification, corrosion, or abnormal wear
Other accessible areas relevant to the vehicle or specifically identified by the client
Not every component or system can be observed or tested on every vehicle.
Inspection depth may vary because of vehicle design, protective covers, ground clearance, seller restrictions, weather, lighting, location, vehicle condition, accessibility, or other circumstances present during the inspection.
3. Non-Invasive Inspection Limitations
ClearPath Auto Check does not normally remove, dismantle, disassemble, or disturb vehicle components in order to perform an inspection.
The inspection does not include:
Disassembly or component removal; destructive or invasive testing; teardown of engines, transmissions, differentials, transfer cases, or other assemblies; removal of interior trim, carpeting, body panels, splash shields, undertrays, wheels, or other installed components solely for inspection purposes; internal mechanical diagnosis; repair services; emissions testing; formal safety testing; vehicle certification; title verification; or vehicle transport.
Areas concealed by installed components, covers, trim, carpeting, insulation, body structures, protective panels, or other obstructions may not be observable.
The inability to inspect a concealed area does not imply that the area is free from defects.
4. Customer-Requested Areas of Attention
The client may identify particular concerns or request that additional attention be given to specific systems, areas, prior repairs, symptoms, vehicle history, or seller representations.
ClearPath Auto Check may incorporate those concerns into the inspection when they fall within the available inspection scope.
A customer request does not expand the inspection into diagnosis, teardown, certification, invasive testing, or any other service outside the normal inspection scope.
Statements made by the client concerning vehicle condition, history, symptoms, prior repairs, or seller representations are treated as unverified intake information unless independently observable during the inspection.
5. Prior Damage and Repairs
When accessible and visible, the inspector may document observable indications of prior damage or repair activity, including differences in panel alignment, finish, paint appearance, fasteners, mounting points, body seams, corrosion, replacement components, or other visible irregularities.
ClearPath Auto Check does not certify the quality, completeness, structural integrity, or correctness of prior repairs.
Concealed collision damage, internal structural damage, repairs hidden beneath panels or trim, and damage that is not visually observable may not be detected.
The absence of visible repair evidence does not establish that a vehicle has never been damaged or repaired.
6. Road Evaluation
A limited road evaluation may be performed when authorized and when vehicle condition, seller or dealership permission, location, traffic, weather, road conditions, and inspector judgment allow.
The purpose of the road evaluation is to observe basic vehicle behavior during ordinary operation.
Observable characteristics may include basic engine response, transmission operation, clutch engagement where applicable, braking behavior, steering response, suspension behavior, driveline operation, warning indicators, noise, vibration, or other conditions that become apparent during the evaluation.
A road evaluation is not guaranteed.
It may be limited, declined, shortened, or discontinued because of vehicle condition, seller restrictions, dealership policy, lack of authorization, registration or insurance concerns, weather, traffic, road conditions, surrounding environment, safety concerns, or inspector judgment.
A road evaluation is not an extended test drive, performance test, endurance test, racing evaluation, towing test, off-road test, safety certification, or guarantee that an intermittent condition will occur.
The absence of an abnormal symptom during the road evaluation does not establish that the condition does not exist.
7. Diagnostic Scanning
When accessible, supported by the vehicle, and compatible with available equipment, ClearPath Auto Check may retrieve diagnostic information from vehicle electronic systems.
Diagnostic scanning may include available stored, pending, permanent, or other fault-code information and basic system or readiness data where supported.
Diagnostic scanning is limited by vehicle design, communication protocols, module accessibility, equipment compatibility, system condition, and available data.
A diagnostic scan is not a complete mechanical or electronic diagnosis.
A code does not necessarily identify the failed component or the root cause of a condition.
A scan may not reveal:
Recently cleared codes; intermittent faults that are not currently stored; internal mechanical defects; conditions that do not trigger diagnostic monitoring; manufacturer-specific information unavailable to the equipment being used; or faults contained in inaccessible or unsupported modules.
The absence of diagnostic trouble codes does not establish that the vehicle is free from mechanical, electrical, or electronic problems.
8. Fluids and Leaks
Accessible fluid levels, visible fluid condition, and visible evidence of leakage may be observed when appropriate and reasonably accessible.
ClearPath Auto Check does not perform laboratory analysis of fluids.
Fluid appearance alone may not establish service history, internal mechanical condition, contamination source, remaining service life, or the cause of a leak.
Leaks or seepage that are concealed, intermittent, cleaned before the inspection, dependent on operating temperature, or located in inaccessible areas may not be detected.
9. Tires, Brakes, Steering, and Suspension
Visible and accessible tire, brake, steering, and suspension components may be reviewed for observable condition.
Tire information such as visible tread condition, sidewall condition, size, and available DOT date information may be documented when accessible.
Brake components may be limited by wheel design and installed components. ClearPath Auto Check does not remove wheels solely for the purpose of inspecting brakes.
Measurements or visual observations represent conditions present at the time of inspection and do not constitute a prediction of remaining component life.
10. Underbody Inspection
Accessible portions of the vehicle underbody may be visually inspected when ground clearance, vehicle position, environmental conditions, and safe access allow.
Vehicles are not automatically lifted or placed on a service hoist as part of a standard mobile inspection.
Underbody visibility may be restricted by ground clearance, aerodynamic panels, splash shields, undertrays, structural components, dirt, corrosion, vehicle positioning, or surrounding conditions.
Areas that cannot be safely accessed or observed will not be inspected invasively.
11. Corrosion and Rust
Visible corrosion or rust may be documented when observed.
The inspection does not determine the full internal extent of corrosion within enclosed frames, subframes, body cavities, seams, structural members, or concealed areas.
Surface appearance does not necessarily indicate the complete extent or severity of corrosion.
ClearPath Auto Check does not certify structural integrity based solely on a mobile visual inspection.
12. Water Intrusion, Flooding, and Environmental Exposure
Visible indicators that may be associated with moisture or water intrusion may be documented when observed.
However, ClearPath Auto Check does not certify whether a vehicle has or has not experienced flooding, water intrusion, storm exposure, coastal exposure, or other environmental damage.
Evidence may be concealed, cleaned, repaired, intermittent, or located in inaccessible areas.
13. Vehicle History, Title, and Third-Party Information
ClearPath Auto Check does not independently guarantee information provided by the seller, dealership, client, vehicle-history provider, manufacturer, repair facility, auction, insurance company, or other third party.
The inspection does not constitute title verification.
ClearPath Auto Check does not guarantee title status, branding, ownership history, accident history, mileage history, lien status, theft history, maintenance history, recall status, or information appearing in third-party databases.
If third-party history information is provided to the inspector, it may be used as contextual information but is not independently guaranteed for accuracy.
14. Hidden, Latent, and Intermittent Defects
Inspection findings are limited to conditions that are visible, accessible, observable, or testable during the inspection.
ClearPath Auto Check is not responsible for defects or conditions that are hidden, concealed, internal, latent, intermittent, intentionally disguised, recently cleared, temporarily repaired, or otherwise not observable at the time of inspection.
Examples may include internal engine wear, internal transmission defects, intermittent electrical failures, concealed collision damage, hidden corrosion, internal fluid contamination, sealed-component defects, intermittent overheating, recently cleared diagnostic information, or symptoms that do not occur during the inspection.
A vehicle may develop a failure after the inspection even when no corresponding abnormality was observable during the inspection.
15. Safety, Roadworthiness, and Regulatory Compliance
ClearPath Auto Check may observe certain safety-related items as part of the inspection, but the inspection is not a formal safety inspection or certification.
ClearPath Auto Check does not certify or guarantee that a vehicle is safe, roadworthy, legally compliant, emissions compliant, suitable for registration, or compliant with federal, state, or local requirements.
Inspection findings should not be interpreted as a governmental, regulatory, emissions, structural, or safety certification.
16. Vehicle Eligibility
Inspection services generally apply to vehicles 25 years old or newer, unless ClearPath Auto Check agrees otherwise in writing.
ClearPath Auto Check may decline or limit service for vehicles whose age, configuration, condition, modification level, access requirements, location, or specialized systems fall outside the practical scope of the service.
Acceptance of an inspection request remains subject to operational and inspector availability.
17. Seller and Dealership Access
The inspection depends on access to the vehicle.
The seller, dealership, auction facility, storage facility, or other vehicle custodian may impose restrictions on where, when, or how the vehicle may be inspected.
ClearPath Auto Check cannot guarantee access to all areas or functions of the vehicle.
Restrictions imposed by a third party may limit road evaluation, diagnostic scanning, underbody access, engine operation, electronic operation, photography, or other inspection activities.
ClearPath Auto Check is not responsible for inspection limitations caused by seller or facility restrictions.
18. Scheduling and Coordination
Payment must be received in full before scheduling and coordination begin unless ClearPath Auto Check agrees otherwise.
After payment is received, ClearPath Auto Check may begin inspector assignment and coordination with the seller or dealership immediately.
Inspection timing depends on inspector availability, seller availability, vehicle access, location, travel requirements, weather, and other operational considerations.
Requested appointment dates or times are not guaranteed until coordination is completed.
19. Client Responsibility for Accurate Information
The client is responsible for providing accurate information regarding the vehicle, seller, location, contact information, and requested service.
This includes, when available, the correct year, make, model, VIN, vehicle location, seller contact information, and known access requirements.
Incorrect or incomplete information may delay or prevent the inspection.
The client should review the quote and payment information before submitting payment and notify ClearPath Auto Check of material errors as soon as possible.
20. Cancellations, Failed Access, and Refunds
Once payment is received, scheduling, inspector assignment, travel planning, seller coordination, and other administrative work may begin.
If the client cancels the inspection, or if the inspection cannot proceed because of circumstances outside ClearPath Auto Check’s control, any applicable refund will be reduced by a 20% administrative and dispatch fee.
Circumstances outside our control may include seller unavailability, refusal of access, inaccurate client-provided information, vehicle removal, seller cancellation, facility restrictions, inability to obtain required authorization, or other circumstances preventing completion after coordination has begun.
If ClearPath Auto Check is unable to perform the inspection for a reason within our control, a full refund will be issued.
21. Inspection Reports and Media
Upon completion, ClearPath Auto Check will provide the client with an electronic inspection report and supporting media as applicable.
Reports and media document conditions observed during the inspection and should be interpreted together with the stated inspection limitations.
Reports and associated inspection media are prepared for the purchasing client.
They are not transferable and are not intended for reliance by sellers, dealerships, subsequent purchasers, lenders, insurers, repair facilities, or other third parties.
22. Photographs and Inspection Documentation
Photographs and other media are collected to document observable vehicle condition and support the inspection report.
The absence of a photograph of a particular component does not establish that the component was inspected from every possible angle or that it was free from defects.
Media coverage may vary depending on access, relevance, visibility, environmental conditions, and inspector judgment.
23. Report Delivery
Reports and associated media are delivered electronically.
The client is responsible for providing accurate email and contact information.
ClearPath Auto Check is not responsible for delays caused by incorrect contact information, spam filtering, email-provider issues, network outages, attachment limitations, or other external communication failures.
Clients who do not receive an expected report should contact ClearPath Auto Check.
24. No Warranty or Guarantee
ClearPath Auto Check does not provide a warranty or guarantee regarding the inspected vehicle.
Inspection findings do not guarantee current or future mechanical condition, electrical condition, structural condition, reliability, lifespan, market value, resale value, maintenance cost, safety, regulatory compliance, or suitability for a particular use.
An inspection reduces uncertainty by providing additional observable information. It does not eliminate the risks associated with purchasing a used vehicle.
25. Repairs and Further Evaluation
An inspection may identify conditions that warrant additional evaluation.
ClearPath Auto Check does not perform repairs as part of the pre-purchase inspection service.
When further diagnosis, disassembly, specialized testing, measurement, alignment verification, structural analysis, manufacturer-level diagnostics, or repair evaluation is needed, the client may choose to have the vehicle examined by an appropriately equipped repair facility or specialist.
The decision to pursue additional evaluation remains with the client.
26. Purchase Decisions
The client remains solely responsible for determining whether to purchase, decline, negotiate for, repair, transport, register, insure, or otherwise proceed with the vehicle.
ClearPath Auto Check provides inspection information but does not act as the buyer, seller, dealer, broker, appraiser, insurer, repair facility, or purchasing agent.
27. Limitation of Liability
To the maximum extent permitted by applicable law, liability for any claim arising from or relating to the inspection service is limited to the total amount actually paid to ClearPath Auto Check for the inspection giving rise to the claim.
28. Acceptance of Terms
By submitting payment, the client confirms that:
The information provided for the inspection is accurate to the best of their knowledge; they understand the inspection is visual, observational, functional, and non-invasive; they understand that hidden, internal, concealed, latent, or intermittent defects may not be detected; they understand that road evaluation and diagnostic scanning are subject to availability, access, authorization, and conditions; and they agree to these Terms & Conditions.
